1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the HomeStaQ mobile application ("the App", "Service") ("we", "us", or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App prior to taking effect. Your continued use of the App following any changes constitutes acceptance of the revised Terms.
2. Description of Service
HomeStaQ is a home management platform that provides the following services:
- Track and manage home appliances, assets, and their associated details
- Store and organise warranty documents, invoices, and service records
- Schedule and track maintenance activities for your household items
- AI-powered appliance detection and document scanning capabilities
- A marketplace to discover and connect with local service technicians
- Real-time booking, chat, and service coordination features
- AI-powered chat assistant for appliance-related guidance
- Household management with support for multiple members
The App is designed primarily for users located in India and its features are optimised for the Indian market.
3. Eligibility
To use HomeStaQ, you must be at least 18 years of age and legally capable of entering into a binding agreement. By using the App, you represent and warrant that you meet these eligibility requirements. If you are using the App on behalf of a household, you represent that you have the authority to bind that household to these Terms.
4. Account Registration and Security
To access the App's features, you must create an account by signing in through one of our supported authentication providers (such as Google, Apple, or WhatsApp). You are responsible for:
- Providing accurate and complete information during registration
- Maintaining the confidentiality and security of your account credentials
- All activities that occur under your account, whether authorised by you or not
- Promptly notifying us of any unauthorised access to or use of your account
We reserve the right to suspend, disable, or terminate accounts that we reasonably believe are being used in violation of these Terms, are involved in fraudulent activity, or pose a security risk to other users or the platform.
5. User Roles
HomeStaQ supports two distinct user roles, each with different capabilities and responsibilities:
5.1 Homeowners
As a homeowner, you can manage your appliances, create service requests, book technicians, manage your household, and access all home management features.
5.2 Service Technicians
As a service technician, you can receive and respond to service requests, manage bookings, build your professional portfolio, and earn ratings from customers. Technicians are independent service providers and are not employees, agents, or contractors of HomeStaQ. HomeStaQ serves only as an intermediary platform to facilitate connections between homeowners and technicians.
Users may hold both roles simultaneously if they choose to register as both a homeowner and a service technician.
6. Service Marketplace and Bookings
HomeStaQ provides a marketplace that connects homeowners with service technicians. By using this marketplace, you acknowledge and agree that:
- Any service agreement or arrangement is solely between the homeowner and the technician
- HomeStaQ does not guarantee the quality, safety, timeliness, or legality of any services provided by technicians
- HomeStaQ does not endorse, certify, or verify the qualifications of any technician beyond the information displayed in their profile
- Pricing for services is agreed upon between the homeowner and technician — HomeStaQ does not set or control pricing
- You are responsible for resolving any disputes arising from a service engagement directly with the other party
We strive to maintain trust and safety on the platform through our rating system, verification tiers, and trust score mechanisms. However, these measures are provided on a best-effort basis and do not constitute a guarantee of service quality.
7. Payments and Fees
HomeStaQ is currently free to download and use. Certain premium features may be introduced in the future, and any applicable fees will be clearly communicated before you are required to pay. Payment processing, when enabled, will be handled through secure third-party payment gateways.
Payments for services booked through the App are arranged directly between the homeowner and technician. HomeStaQ does not process, hold, or guarantee any payment between users.
8. User Content and Community Standards
You retain ownership of all content you upload, submit, or create through the App, including but not limited to photographs, documents, appliance data, reviews, chat messages, and feedback ("User Content"). By uploading or submitting User Content, you grant HomeStaQ a non-exclusive, worldwide, royalty-free, transferable licence to use, store, display, reproduce, and process your User Content solely for the purpose of providing and improving the Service. You represent and warrant that you own or have the necessary rights to all User Content you submit, and that it does not infringe upon the intellectual property, privacy, or other rights of any third party.
To keep the platform safe for everyone, you must not send or post content that is abusive, threatening, sexually explicit, hateful, or otherwise illegal. This applies to all chat messages, reviews, profile information, and any other content submitted through the App. All reported content is reviewed by our team, and accounts found in violation are removed within 24 hours of a valid report being confirmed.
You may block any other user at any time using the block feature available in the chat screen. Blocking prevents future contact and matching with that user. To request urgent removal of abusive content, contact us directly at support@homestaq.in — we treat takedown requests as a priority.
9. AI-Powered Features
HomeStaQ uses artificial intelligence to provide features such as appliance detection, document scanning, and the chat assistant. You acknowledge and agree that:
- AI-generated information is provided for guidance purposes only and may not always be accurate or complete
- You should independently verify any AI-generated appliance details, maintenance recommendations, or other suggestions before relying on them
- The AI chat assistant is limited to appliance and home maintenance topics and may decline to answer unrelated questions
- We may use your interactions with AI features to improve their accuracy and performance, in accordance with our Privacy Policy
10. Prohibited Conduct
You agree not to engage in any of the following activities while using the App:
- Using the App for any unlawful, fraudulent, or malicious purpose
- Providing false, misleading, or inaccurate information in your profile, listings, or communications
- Impersonating another person or entity, or falsely claiming an affiliation
- Attempting to gain unauthorised access to other users' accounts, our systems, or any related networks
- Reverse-engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the App
- Interfering with or disrupting the integrity or performance of the App or its underlying infrastructure
- Harassing, threatening, abusing, or intimidating other users
- Uploading content that is defamatory, obscene, offensive, or infringes on any third party's rights
- Using automated means (bots, scrapers, crawlers) to access or interact with the App
- Circumventing or manipulating the rating, trust score, or verification systems
- Soliciting other users for services or transactions outside the App to avoid platform features
Violation of these prohibitions may result in immediate suspension or termination of your account, at our sole discretion, without prior notice.
11. Intellectual Property
The App, including its design, code, graphics, logos, icons, user interface, and all related intellectual property, is owned by or licensed to HomeStaQ and is protected by applicable copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose, subject to these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any of its content without our prior written consent.
12. Third-Party Services
The App integrates with and relies on third-party services for authentication, data storage, AI features, notifications, and other functionality. Your use of these third-party services is subject to their respective terms of service and privacy policies. HomeStaQ is not responsible for the availability, accuracy, or practices of any third-party service.
13. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any information provided through the App, including AI-generated content. You use the App at your own risk.
14. Limitation of Liability
To the maximum extent permitted by applicable law, HomeStaQ and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the App, any services booked through the App, or any conduct of other users.
Our total aggregate liability for any claims arising out of or relating to these Terms or the App shall not exceed the amount you have paid to HomeStaQ, if any, in the twelve (12) months preceding the claim, or One Thousand Indian Rupees (INR 1,000), whichever is greater.
15. Indemnification
You agree to indemnify, defend, and hold harmless HomeStaQ and its developer from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your User Content; (d) your interaction with other users; or (e) any services provided or received through the App.
16. Termination
You may terminate your use of the App at any time by deleting your account through the App's settings. We may suspend or terminate your account or access to the App at any time, with or without cause or notice, including but not limited to if we reasonably believe you have violated these Terms.
Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
Before initiating any formal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at homestaq.support@gmail.com. We will endeavour to resolve any concerns within 30 days of receipt.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeStaQ regarding your use of the App and supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter hereof.
